Essential Guide to CBAM Authorization: Avoiding Import Disruptions

The CBAM authorization process is critical for any company aiming to align with new European regulations and prevent disruptions in commercial activities. It’s not only mandatory but also a demonstration of compliance and reliability to international partners. Therefore, a thorough understanding of the steps necessary to obtain authorization can make the difference between success and potential administrative failure.

  1. Application Submission: First Steps Toward Compliance
To obtain CBAM authorization, applicants must submit several documents proving the integrity and transparency of their business. A key requirement is certification from the tax authority of the member state, confirming that the applicant has no outstanding tax debts. Additionally, a sworn declaration must be submitted, stating that no serious breaches of customs or tax laws have occurred in the last five years.
  2. Demonstrating Financial and Operational Capacity
The application must include details showing that the company can comply with CBAM regulations. It is essential to provide financial documents, such as profit and loss statements and balance sheets from the last three financial years, to support the applicant’s financial capacity. These are complemented by monetary forecasts and import volumes for the next two years, providing a clear picture of the company’s operations within the European context.
  3. Obtaining Authorized Declarant Status: Key Criteria
To be recognized as an authorized declarant, the applicant must prove compliance with customs and tax laws and have a stable presence in the EU. Additionally, having an EORI number is essential to participate in EU customs procedures. This status simplifies interactions with customs authorities and speeds up commercial processes.
  4. The Urgency of Action: Avoiding Complications
Since the authorization process can take over six months, it is essential for companies not to delay starting it. Businesses are advised to begin preparing authorization documents starting December 31, 2024. This ensures compliance and a smooth transition to the new regulations, starting January 1, 2026.

CBAM authorization is not just a legal requirement but also an opportunity to demonstrate a commitment to responsible and sustainable trade. By clearly understanding the requirements and acting promptly, companies can successfully navigate this complex process, ensuring their commercial activities continue to thrive under the new European legislation.
